Governing the Use of Cleaning Services

1. Introduction

Welcome to Neto’s Cleaning. These Terms and Conditions (“Terms“) govern your access to and use of the cleaning services provided by Neto’s Cleaning (“we,” “us,” or “our”). By scheduling, receiving, or otherwise utilizing any services offered by Neto’s Cleaning, you (“Client,” “you,” or “your”) agree to be bound by these Terms, which constitute a legally binding agreement between you and Neto’s Cleaning. Please read these Terms carefully before using our services.

2. Acceptance of Terms

Your engagement with Neto’s Cleaning, including but not limited to requesting a quote, scheduling a service, or allowing our personnel to perform services on your property, signifies your unequivocal acceptance of these Terms. If you do not agree to these Terms, you must not use our services.

3. Services Provided

Neto’s Cleaning offers a range of residential and commercial cleaning services. The specific scope of services for each booking will be detailed in your service agreement or booking confirmation. We reserve the right to refuse service if the requested tasks are deemed unsafe, beyond our expertise, or outside the agreed-upon scope.

4. Scheduling and Cancellations

All service appointments are subject to availability. We recommend scheduling in advance to secure your preferred date and time. Our cancellation policy is as follows:

  • Cancellations with 24+ Hours Notice: If you cancel or reschedule your service with at least twenty-four (24) hours’ notice prior to the scheduled appointment time, no cancellation fee will be charged.
  • Same-Day Cancellations: For cancellations or rescheduling requests made on the same day as the scheduled service, a cancellation fee equivalent to fifty percent (50%) of the total service cost will be applied. This fee compensates for lost revenue and operational costs.

5. Payments

Payment for services rendered is due upon completion of the cleaning service, unless otherwise agreed upon in writing. We accept major credit cards and bank transfers. All prices are quoted in United States Dollars (USD). Failure to make timely payment may result in late fees or suspension of future services. We do not store your full payment card details on our servers; all transactions are processed securely through third-party payment gateways.

6. Communication

Neto’s Cleaning may communicate with you via email, phone calls, or SMS (text messages) regarding your service appointments, confirmations, reminders, and other service-related information. By providing your phone number, you consent to receive SMS messages from us for these purposes.

  • SMS Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message received.
  • SMS Assistance: For assistance with SMS communications, reply HELP.
  • No Sharing of SMS Data: We do not sell, rent, or share your phone number or SMS consent information with third parties or affiliates for marketing purposes. Your information is used solely to facilitate our services to you.

7. Client Responsibilities

To ensure the efficient and safe delivery of our services, the Client agrees to:

  • Provide Access: Ensure clear and safe access to the property at the scheduled service time. If our team cannot access the property, a cancellation fee may apply.
  • Secure Valuables/Fragile Items: Remove or secure any valuable, fragile, or sentimental items prior to the cleaning service. This includes jewelry, cash, important documents, electronics, and delicate decorations.
  • Safe Working Environment: Maintain a safe working environment for our cleaning professionals, free from hazards such as aggressive pets, exposed wires, or hazardous chemicals. We reserve the right to refuse service if the environment is deemed unsafe.
  • Disclose Special Conditions: Inform Neto’s Cleaning of any specific conditions, allergies, or requirements that may affect the cleaning process or the health and safety of our staff.

8. Limitations of Liability

Neto’s Cleaning strives to provide high-quality services. However, we are not liable for:

  • Pre-existing Damage: Any damage to your property that existed prior to the commencement of our cleaning services.
  • Undisclosed Items: Damage to items that were not secured or disclosed as fragile or valuable by the Client.
  • Consequential Damages: Any indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
  • Refusal of Service: Any inconvenience or loss incurred due to our refusal to perform services in an unsafe environment or for tasks outside our agreed scope.
  • Maximum Liability: In no event shall Neto’s Cleaning’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you for the specific service giving rise to the liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless Neto’s Cleaning, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms.

10. Changes to These Terms

Neto’s Cleaning reserves the right to modify or update these Terms at any time, at our sole discretion. Any changes will be effective immediately upon posting the revised Terms on our website or by notifying you via email. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically to stay informed of any updates.

11. Governing Law and Jurisdiction

These Terms and your use of our services shall be governed by and construed in accordance with the laws of the State of Massachusetts, USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Massachusetts, and you hereby consent to the personal jurisdiction and venue therein.
